These Terms & Conditions (“Terms”) govern your use of the Heart & Hearth Pottery website, studio, classes, workshops, events, memberships, retail purchases, and all related services (“Services”). By accessing the website, registering, purchasing, or attending the studio, you agree to be bound by these Terms and all incorporated policies.
Please read these Terms carefully before registering or purchasing. If you have questions, contact us at heartandhearthpottery@gmail.com before completing your transaction.
1. Nature of Services
Heart & Hearth Pottery is an experiential, process-based ceramic studio. Services are instructional and participatory in nature. Ceramic processes involve inherent variability — results, outcomes, and finished work are not guaranteed. Loss or imperfection during the making or firing process does not constitute negligence or grounds for refund.
All Services are provided in good faith, based on current studio capacity, instructor availability, and enrollment. The studio reserves the right to modify, reschedule, or cancel offerings due to operational needs, insufficient enrollment, or safety concerns. In the event of a studio-initiated cancellation, participants will receive a full refund or credit at their election.
2. Policy Hierarchy & Incorporated Documents
These Terms incorporate by reference the following studio policies, each of which governs specific aspects of your relationship with the studio:

Booking, Cancellation & Studio Policies — governs refunds, credits, makeup sessions, and attendance

Privacy Policy — governs collection, use, and protection of personal information

Accessibility Statement — governs accommodation requests and studio access

Liability Waiver — governs assumption of risk and release of claims for physical injury

Media Release — governs photography and use of images

Membership Agreement — governs studio membership terms where applicable
All incorporated policies are available on our website and upon written request. In the event of conflict between these Terms and an incorporated policy, the more specific policy controls. The Liability Waiver controls for all physical injury or safety-related claims.
By completing registration or purchase, you acknowledge that you have had the opportunity to review these Terms and all incorporated policies, including our Privacy Policy describing how your personal information is collected and used.
3. Registration, Payment & Retail
All prices are stated in U.S. dollars. Full payment is required at the time of booking or purchase. Your spot in a class, workshop, or event is not reserved without payment.
Retail items including clay, tools, and gift cards are subject to the terms of the Booking, Cancellation & Studio Policies. Gift cards are non-refundable but may be transferred.
The studio reserves the right to cancel or modify offerings and will provide advance notice where possible. Participants who have prepaid for cancelled offerings will receive a full refund or credit.
4. Recurring Billing & California Automatic Renewal Disclosure
IMPORTANT NOTICE REQUIRED BY CALIFORNIA LAW (Business & Professions Code § 17600 et seq.)
Several Heart & Hearth programs are offered on a recurring monthly basis, including class series, Kids Clay Club, Teen Studio, and Studio Memberships. If you enroll in a recurring program, the following applies:

Your enrollment will automatically renew each month at the stated price until you cancel

You will be charged the monthly fee on the same date each billing cycle

To cancel a recurring enrollment, you must provide written notice at least 7 days before the next billing date

Cancellations may be submitted by email to heartandhearthpottery@gmail.com

You may cancel at any time; cancellation takes effect at the end of the current billing period

No refund is issued for the current billing period after the cancellation deadline has passed, except where required by law
Before completing enrollment in any recurring program, you will be presented with a clear summary of the charge amount, billing frequency, and cancellation instructions at checkout. Your affirmative agreement at that point constitutes acceptance of these recurring billing terms.
If you believe a recurring charge was made in error, contact us immediately at heartandhearthpottery@gmail.com. We will investigate and respond within 5 business days.
5. Attendance & Personal Responsibility
Participants are responsible for managing their own attendance, monitoring studio communications, and understanding applicable policies. The studio is not responsible for providing individual reminders or tracking attendance on a participant’s behalf.
Missed sessions do not automatically create refund or credit eligibility. Please refer to the Booking, Cancellation & Studio Policies for the studio’s makeup and credit provisions, which govern attendance-related adjustments.
6. Open Studio & Practice Time
Open studio and practice time may be offered as part of certain class formats or memberships. Where open studio time is included in your enrollment or membership, it will be stated explicitly in your registration confirmation or membership agreement.
Open studio time that is included in a paid enrollment is subject to studio scheduling, instructor availability, and safety supervision requirements. It does not accrue between billing periods or roll over if unused. Unsupervised access to the studio is prohibited unless expressly authorized in writing.
Open studio time that is offered on a discretionary or ad hoc basis — not specified in your registration — is not a guaranteed benefit and may be offered or adjusted at the studio’s discretion.
7. Conduct & Termination
Use of the Services requires respectful, safe, and appropriate conduct at all times. This applies to behavior in the studio, in written and verbal communications with studio staff, instructors, and other participants, and in any online or social media context referencing the studio.
The studio may suspend or terminate access to Services for:

Unsafe behavior or misuse of equipment

Threatening, aggressive, or harassing conduct toward any person

Violation of studio standards or incorporated policies

Conduct that creates risk to the safety or wellbeing of others
In the event of termination for conduct reasons, the studio will provide written notice and a pro-rata refund of any prepaid fees for sessions not yet delivered at the time of termination. The studio reserves the right to withhold this refund only where the conduct resulted in documented damage or financial harm to the studio, up to the cost of that damage.
Termination is a last resort. The studio will generally attempt to resolve conduct concerns through direct communication before terminating access.
8. Materials, Equipment & Damage
Only materials approved by Heart & Hearth Pottery may be used in the studio. Use of unapproved materials — including outside clay, glazes, or chemicals — may damage equipment, affect other participants’ work, and create kiln safety hazards. Participants who cause damage through use of unapproved materials or through negligent or intentional misuse of equipment may be held financially responsible for the cost of repair or replacement.
9. Firing & Finished Work
Ceramic firing is an inherently unpredictable process. Loss, cracking, glaze defects, and other outcomes are natural risks of the medium and do not constitute negligence on the part of the studio or instructor. Firing losses do not create grounds for refund.
Finished work must be retrieved according to the studio’s pickup policy, which is communicated at the time of class completion. Greenware not picked up within 2 weeks and fired work not retrieved within 30 days may be repurposed or discarded at the studio’s discretion.
10. Minors
For the purposes of these Terms, a minor is any individual under the age of 18. The parent or legal guardian of a minor participant is responsible for providing all required consents, signing all required waivers and agreements on the minor’s behalf, ensuring the minor’s conduct meets studio standards, and accepting financial responsibility for any damage caused by the minor.
By registering a minor for any studio program, the parent or guardian affirms that they have read and agree to these Terms, the Liability Waiver, and all applicable studio policies on behalf of the minor and themselves.
The studio may remove a minor from any activity for safety or conduct reasons. In such cases, the studio will contact the parent or guardian immediately. Refund eligibility in this circumstance follows the conduct termination provisions of Section 7.
California law limits the enforceability of liability waivers signed on behalf of minors. The studio’s Liability Waiver includes specific provisions addressing minor participant agreements. Parents and guardians should review that document carefully.
11. Photography & Shared Studio Environment
Heart & Hearth Pottery is a shared creative space. Photography or video recording may occur during classes and events — by the studio, instructors, or other participants. The studio’s use of images is governed by the Media Release incorporated into your registration. Participants who do not wish to appear in studio-controlled media should notify us in writing before their first session.
The studio is not responsible for media captured or shared by other participants in the shared studio environment. Participation constitutes acknowledgment that complete photographic privacy cannot be guaranteed in a group setting.
12. Limitation of Liability
To the fullest extent permitted by California law, Heart & Hearth Pottery’s liability for claims arising from these Terms or the Services — excluding personal injury claims, which are governed by the separately executed Liability Waiver — is limited to the total amount paid by the participant for the specific Service giving rise to the claim.
The studio is not liable for indirect, incidental, consequential, or punitive damages arising from participation, scheduling changes, firing outcomes, property stored in the studio, or circumstances beyond the studio’s reasonable control.
This limitation applies to financial and property claims only. Physical injury claims are governed exclusively by the Liability Waiver signed at intake.
13. Indemnification
You agree to indemnify and hold harmless Heart & Hearth Pottery, its owner, instructors, and agents from and against any claims, damages, or expenses — including reasonable attorney’s fees — arising from your participation in studio activities, your conduct in the studio, your violation of these Terms, or damage caused by you or a minor in your care.
14. Billing Disputes
If you believe a charge was made in error, please contact us in writing at heartandhearthpottery@gmail.com before initiating a dispute with your bank or payment provider. We will investigate and respond within 5 business days. Many billing concerns can be resolved quickly through direct communication.
You retain the right to dispute any charge with your bank or payment provider as provided under the Fair Credit Billing Act and applicable law. This right cannot be waived by contract. If you have contacted us first and have not received a response within 5 business days, you are free to escalate through your financial institution.
15. Force Majeure & Studio Closure
The studio’s obligation to deliver Services may be suspended or terminated without penalty in the event of circumstances beyond its reasonable control, including but not limited to: wildfire, natural disaster, public health emergency, loss of studio access, or other events that make safe operation impossible.
In such cases, the studio will provide as much advance notice as reasonably possible. Participants who have prepaid for Services that cannot be delivered due to a force majeure event will receive a full refund or credit at their election, within 30 days of the event.
16. Arbitration & Dispute Resolution
Any dispute arising from or related to these Terms or the Services that cannot be resolved through direct communication will be submitted to binding arbitration under the rules of a mutually agreed arbitration provider in Los Angeles County, California. The arbitration will be conducted on an individual basis. You waive the right to participate in a class action lawsuit or class-wide arbitration related to the Services.
Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.
Arbitration does not prevent you from filing a complaint with the California Civil Rights Department, the California Attorney General, or any other applicable regulatory agency.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of these Terms will continue in full force and effect.
18. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes not subject to arbitration under Section 16 shall be resolved in the courts of Los Angeles County, California.
19. Updates to These Terms
The studio may update these Terms from time to time. The version in effect at the time of your registration or purchase governs that transaction. Material changes will be communicated by email to active members and enrolled students at least 14 days before taking effect. Continued enrollment or participation after the effective date of any update constitutes acceptance of the revised Terms.
20. Entire Agreement
These Terms, together with all incorporated policies, constitute the entire agreement between you and Heart & Hearth Pottery with respect to the Services. They supersede any prior understandings, communications, or agreements, whether written or oral. No modification of these Terms is effective unless made in writing and signed by the studio owner.
